A master’s thesis at the College of Law at the University of Karbala discussed the role of Islamic Sharia principles in the dissolution of the marriage contract, submitted by student Muhammad Jawad Ahmed.
The study aimed to explain the role of Islamic Sharia principles in formulating the provisions for dissolution of the marriage contract in the Iraqi Personal Status Law.
The study concluded that the Iraqi legislator achieved balance through consensual divorce by requiring the spouses to agree to it or agree on the amount of compensation.
The study recommended that the Iraqi legislator should give the wife the right to request separation. If her husband is sentenced to a custodial sentence for three years or more from the date on which the decision becomes final.
